alright, my friend believes that if you cover a song live you have to pay royalties to the creator, he wont believe me when i tell him no. anyone here be able to give me solid proof?

Bands that play covers generally do not have to pay for rights. Clubs who have music should be paying a flat license fee to ASCAP and BMI to cover rights.

Not only that, but royalties are handled differently if you record a cover live vs. in the studio.

That wouldn't make sense. Because then what about dj's they would have to pay royalties too. It would be impossible to make money at music. If you sell recordings thats when it changes I believe. correct me if im wrong

The VENUES pay a blanket fee for music performance. Doesn't matter if its live or canned, except for the rate they pay ASCAP and BMI.
So, if a DJ plays a club, the club should have paid a yearly fee to cover the use of the music. The DJ doesn't pay.

BMI and ASCAP, etc. use very complicated formulas to figure out how often a particular song gets played in juke boxes, muzak, cover bands clubs, radio, etc. towards the owners of the copyrights, publishers, etc.
Technically, club owners pay a fee for having cover bands, DJ's, etc. How this is collected is beyond me.

I'm not positive but I've talked to a few club owners that said it depended on the seating capacity/sq.ft. etc. Doesn't matter if no one comes are it is overpacked.
